Right of Withdrawal

Applicability

The following withdrawal instructions apply where a statutory right of withdrawal exists.

For the Simply Yoga Monthly Membership, consumers entering into a distance contract generally have a statutory 14-day right of withdrawal, subject to the statutory requirements and exceptions.

For a Simply Yoga Drop-In booked for a specific date, the statutory right of withdrawal may be excluded where the contract falls within the statutory exception for services related to leisure activities that provide for a specific date or period, in particular § 312g(2)(9) BGB.

Withdrawal instructions

Where a statutory right of withdrawal exists, you have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded.

To exercise your right of withdrawal, you must inform:

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract.

We will make the reimbursement using the same means of payment as you used for the original transaction, unless you have expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

If you expressly requested that the services begin during the withdrawal period, you may be required to pay a reasonable amount corresponding to the proportion of the services already provided up to the time when you inform us of your exercise of the right of withdrawal, compared with the full scope of the services provided for in the contract, where the statutory conditions are met.

For a paid service, the right of withdrawal does not expire merely because performance has begun. It may expire upon complete performance only where the statutory requirements are satisfied, including the consumer’s required express consent and acknowledgment.
